Project Presentation for Audiovisual Work
The Website contains a form that allows you to present your audiovisual project (the “Project”) to FEDE ENTERTAINMENT SPAIN, whereby you will only be permitted to provide your name, email address, and a short synopsis or logline of the Project. By accepting these terms, you (the User) guarantee, with the acceptance of these terms, (i) that you are the sole owner of the intellectual property rights, exploitation rights, and/or the right to represent the Project to third parties, without requiring authorization from any other person or entity; and (ii) that it is an original idea that does not infringe upon the rights of third parties.
Under these conditions, and subject to the User’s acceptance of these terms, FEDE ENTERTAINMENT SPAIN agrees to receive the aforementioned short synopsis or logline of the Project for the purpose of evaluating the possibility of proceeding with its development and/or production.
FEDE ENTERTAINMENT SPAIN’s receipt of the short synopsis or logline of the Project is subject to the following conditions and to the following representations by you:
- FEDE ENTERTAINMENT SPAIN will treat the information provided regarding the Project as confidential, disclosing it only to those collaborators, employees, and personnel bound by employment or commercial relationships with our entity or any of its subsidiaries or affiliated companies who need to know it to carry out the purposes outlined in the previous paragraph, and who are also bound by the same confidentiality commitment.
- For purposes of the above commitment, information or elements of the Project will not be considered confidential if (i) they are or become public domain without fault or breach by FEDE ENTERTAINMENT SPAIN, or (ii) they are similar or coincident with projects or elements of projects in FEDE ENTERTAINMENT SPAIN’s project portfolio, as referred to in the following paragraph.
- You understand and accept that: (i) FEDE ENTERTAINMENT SPAIN, due to its position in the entertainment industry, receives, acquires, generates, and internally develops—through its employees or third parties on its behalf—a considerable amount of audiovisual content material and thus has in its portfolio numerous audiovisual projects spanning various genres; (ii) these projects may be similar or coincident with the Project you present or with elements of your Project; (iii) mere similarity between elements of our projects and your Project does not necessarily constitute plagiarism; and (iv) FEDE ENTERTAINMENT SPAIN has full freedom to develop and produce the projects in its portfolio, and this alone cannot be regarded as an infringement of your rights over the Project nor entitle you to any remuneration, compensation, or indemnification.
- You understand and agree that this letter does not constitute an offer or commitment regarding the Project. FEDE ENTERTAINMENT SPAIN has no obligation towards you if it decides not to use the Project for any purpose. Should FEDE ENTERTAINMENT SPAIN express interest in your Project following its review, FEDE ENTERTAINMENT SPAIN will provide you with a collaboration agreement proposal.
